Background. The article is devoted to the topic of state-legal architectonics in the field of education and science, which is relevant in the conditions of modern political and economic reality, viewed through the prism of the constitutional law of the USSR of the second half of the 20th century. In an era when the public demand for interaction between the state and institutions of education and science has become the arena of national and global debates, the Soviet experience of centralized management, structural integration, and regulatory regulation of educational and scientific activities is of particular importance for historical and legal reconstruction and ideological analysis. The subject of the research is the historical and legal foundations, the peculiarities of regulatory regulation, the transformation of subjectivity and the institutional environment of education and science in the USSR in 1953-1982.
Purpose. The purpose of the study is to comprehensively disclose the constitutional, sectoral and subordinate legal mechanisms of the state-legal organization of education and science in the Soviet period of 1953-1982, as well as to clarify the relationship of rights, duties, guarantees and restrictions that set the historical framework for the development of Soviet society.
Methodology. The research is based on historical and legal analysis, a comparative approach, and elements of systemic legal modeling. The methods include detailed hermeneutics of Soviet normative acts, phenomenology of the constitutional law of education and science, comparison with Western models, as well as reconstruction of processes and trends based on official documentation, monographs and textbooks.
Results. As a result of the research, the dual nature of the constitutional and sectoral regulations of education and science has been revealed: a combination of the proclaimed mass accessibility, social security and the obligatory ideological determinism of daily work. A characteristic feature is a rigid normative hierarchy in which any manifestation of autonomy was either strictly limited or transformed to meet the needs of the party – state apparatus. It is shown that the Soviet legal model in the field of education and science proved to be effective in terms of quantitative success (the elimination of illiteracy, the creation of a network of universities and research institutes, the formation of a scientific elite), but had systemic limitations in terms of independence, interdisciplinary and international contacts.
Practical implications. The results of the research are valuable for specialists in the field of legal history, educational policy, science management and the design of a modern regulatory framework, and can also be used in the development of new models of state-legal interaction in globalized societies.
Обоснование. Статья посвящена актуальной в условиях современной политико-экономической реальности теме государственно-правовой архитектоники в сфере образования и науки, рассматриваемой сквозь призму конституционного права СССР второй половины XX века. В эпоху, когда общественный запрос на взаимодействие государства и институтов образования и науки вновь ареной национальных и глобальных дебатов, советский опыт централизованного управления, структурной интеграции, нормативно-правовой регламентации образовательной и научной деятельности приобретает особую значимость для историко-правовой реконструкции и идейного анализа. Предметом исследования выступают историко-правовые основания, особенности нормативного регулирования, трансформация субъектности и институциональной среды образования и науки в СССР в 1953-1982 годах.
Цель. Целью исследования является комплексное раскрытие конституционных, отраслевых и подзаконных механизмов государственно-правовой организации образования и науки в советский период 1953-1982 годов, а также выяснение соотношения прав, обязанностей, гарантий и ограничения, задававших исторические рамки развития советского общества.
Методология. Основу исследования составляют историко-правовой анализ, компаративистский подход и элементы системного правового моделирования. Методы включают детальную герменевтику советских нормативных актов, феноменологию конституционного права образования и науки, сопоставление с западными моделями, а также реконструкцию процессов и тенденций на основании официальной документации, монографий и учебников.
Результаты. В результате исследования выявлена двойственная природа конституционной и отраслевой регламентации образования и науки: сочетание провозглашаемой массовой доступности, социальной защищенности и обязательной идеологической детерминированности повседневной работы. Характерная черта – жесткая нормативная иерархия, в которой любое проявление автономии либо строго лимитировалось, либо было трансформировано под нужды партийно-государственного аппарата. Показано, что советская правовая модель в сфере образования и науки оказалась эффективна в плане количественных успехов (ликвидация неграмотности, создание сети вузов и НИИ, формирование научной элиты), однако имела системные ограничения в отношении самостоятельности, междисциплинарных и международных контактов.
Область применения результатов. Результаты исследования имеют ценность для специалистов в области истории права, образовательной политики, управления наукой и проектирования современной нормативно-правовой базы, а также могут быть использованы при разработке новых моделей государственно-правового взаимодействия в глобализированных обществах.
